1. Xaysi Inc.’s Role
Xaysi Inc. serves as a marketplace that facilitates the connection between independent sellers and buyers. While we provide the platform for these transactions, sellers are responsible for the content they upload and ensuring that their listings do not infringe upon any intellectual property rights. Xaysi does not manufacture, stock, or ship products on behalf of sellers.
Sellers are required to ensure that they hold the necessary rights to all content uploaded to the platform, and that they do not violate the intellectual property rights of others. Xaysi Inc. reserves the right to remove or disable access to any listing, shop, or account that violates this policy or any other applicable terms, including our Prohibited Items Policy. We may also take action against users who repeatedly abuse these policies.
While we do not offer legal advice or determine ownership of intellectual property, Xaysi Inc. will promptly respond to valid infringement reports by removing or disabling access to the allegedly infringing content.
2. Intellectual Property Infringement Reporting
If you believe that your intellectual property rights have been violated on Xaysi Inc., you can submit an infringement report through our designated Reporting Portal. We will review these reports in accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, depending on the location of the complainant.
To submit an infringement report:
- Use the Reporting Portal: This is the most efficient method for handling infringement claims under U.S. law and other jurisdictions.
- Additional Information: Xaysi Inc. may request further documentation, such as a letter of authorization from the rights holder or identity verification from the complainant. Please ensure that your report is complete, truthful, and submitted in good faith. Incomplete or fraudulent reports will not be processed.
Regional Infringement Reporting:
- Canada: Canadian users can file an infringement report using the Reporting Portal. Additional information may be requested in compliance with Canadian intellectual property laws.
- United Kingdom: Infringement reports for U.K. users will be processed according to U.K. intellectual property laws via the Reporting Portal.
- Ireland: Infringement claims for users in Ireland are handled through the Reporting Portal, in line with Irish intellectual property regulations.
- Nigeria: Nigerian users can submit reports through the Reporting Portal, ensuring compliance with Nigerian intellectual property laws.
3. Counter Notices
In accordance with the DMCA, sellers in the U.S. whose content has been removed or disabled incorrectly may submit a counter notice. If valid, the content may be reinstated after 10 business days unless the copyright holder initiates legal action.
Regional Counter Notices:
- Canada: Canadian sellers can submit a counter notice if their content was wrongly removed under Canadian law. If valid, the content may be reinstated after 10 business days unless legal action is initiated by the rights holder.
- United Kingdom & Ireland: Sellers in the U.K. and Ireland who believe their content was wrongfully removed can submit a counter notice under applicable laws. Valid counter notices will result in content reinstatement after 10 business days unless legal action is pursued.
- Nigeria: Sellers in Nigeria can submit a counter notice if their content was removed in error. If valid, the content will be restored after 10 business days unless the copyright owner takes legal action.
4. Repeat Infringement
Xaysi Inc. may terminate the accounts of sellers who consistently violate intellectual property rights or are the subject of multiple infringement reports. Additionally, we reserve the right to refuse service to users who attempt to bypass these policies by creating new accounts.
Xaysi Inc. maintains the authority to suspend or terminate accounts at any time, with or without notice, in accordance with our Terms of Use.
5. Withdrawal of Infringement Reports
Only the intellectual property owner or their authorized representative may withdraw an infringement report. The withdrawal request must be formal and provide sufficient details (e.g., username, shop name, listing URLs) to identify the affected content. Upon receiving a valid withdrawal request, we will confirm receipt and notify the seller involved.
Please note that withdrawing an infringement report does not automatically guarantee changes to the seller’s status or the removal of the listing. All withdrawals will be reviewed on a case-by-case basis.
